José Roberto Arruda celebrou o voto do ministro Gilmar Mendes, do Supremo Tribunal Federal (STF), sobre a aplicação das mudanças na contagem do prazo de inelegibilidade previstas na Lei da Ficha Limpa. Em vídeo publicado nas redes sociais na sexta-feira (11), o ex-governador do Distrito Federal afirmou ter convicção de que poderá disputar as eleições de 2026.
Ao comentar o posicionamento de Gilmar Mendes, Arruda declarou que já tinha confiança de que a legislação estava a seu favor. “Eu tinha convicção do meu direito”, afirmou.

O ex-governador também reforçou que pretende manter sua candidatura ao Governo do Distrito Federal. “Eu sou candidato, estou pronto”, disse.
O voto de Gilmar Mendes foi apresentado no julgamento da Ação Direta de Inconstitucionalidade (ADI) 7881, que discute mudanças na aplicação das regras de inelegibilidade da Lei da Ficha Limpa. O ministro defendeu um período de transição de 18 meses para a alteração na contagem do prazo.
O entendimento pode beneficiar Arruda, que teve o registro de candidatura ao governo do Distrito Federal negado pelo Tribunal Regional Eleitoral (TRE-DF). A decisão ainda é alvo de recurso.
O julgamento da ADI 7881, que ocorria no plenário virtual do STF, foi levado para análise presencial após pedido de destaque do ministro Flávio Dino. Ainda não há data definida para a retomada da análise.
Entenda o caso
Arruda teve o registro de candidatura ao Governo do Distrito Federal indeferido pelo Tribunal Regional Eleitoral do DF (TRE-DF), após pedido do Ministério Público Eleitoral. A decisão considerou que o ex-governador permanece inelegível em razão de condenações por improbidade administrativa relacionadas à Operação Caixa de Pandora.
A defesa, por outro lado, sustenta que as mudanças feitas na Lei da Ficha Limpa em 2025 alteraram a forma de contagem do prazo de inelegibilidade e poderiam permitir a candidatura em 2026.
Mesmo com o registro indeferido, Arruda pode continuar realizando atos de campanha enquanto o processo não tiver uma decisão definitiva. O TRE-DF assegurou a possibilidade de prática de atos relativos à campanha, incluindo propaganda e utilização do horário eleitoral, enquanto houver recurso pendente. O ex-governador já afirmou que pretende recorrer ao Tribunal Superior Eleitoral (TSE).
